Constitutional Right to Abortion
The constitutional right to abortion was established by Roe v. Wade. Although there are many federal and state laws that restrict abortion access, the fact remains that all people in the United States are guaranteed the right to seek abortion care. After the Supreme Court of the United States failed to block Texas’s Senate Bill 8, DOJ filed a lawsuit in federal court to block the unconstitutional ban. Attorney General Merrick Garland stated, “The Act is clearly unconstitutional under longstanding Supreme Court precedent. The United States has the authority and responsibility to ensure that no state can deprive individuals of their constitutional rights through a legislative scheme specifically designed to prevent the vindication of those rights.”
